Terms of Service

Article 1 (Purpose)
These Terms set forth the rights and obligations between the operator and members concerning the use of the onlytems service (domain: onlytems.com, hereinafter the "Service") provided by onlytems (hereinafter the "Operator"), as well as other necessary matters.
Article 2 (Definitions)
The terms used in these Terms are defined as follows:
1. "Service" means the online trade information brokerage platform provided by the Operator that allows members to list, search, and connect with counterparties for in-game items of "Diablo IV".
2. "Member" means a person who has agreed to these Terms and has entered into a service usage agreement through Battle.net account authentication.
3. "Listing" means a trade information post about an in-game item that a member registers on the Service for trading purposes.
4. "Offer (Bid)" means an act by which a member expresses an intention to trade on another member's listing.
5. "Mana" means an in-service activity point that is granted free of charge and has no cash redemption or monetary value, used for in-service activities such as creating listings and making offers.
6. "Content" means all posts that a member registers or publishes on the Service, including listing information, seller notes, reviews, nicknames, and uploaded images.
Any term not defined in these Terms shall follow the meaning prescribed by applicable laws and individual service notices.
Article 3 (Posting and Amendment of Terms)
1. The Operator shall post the contents of these Terms on the Service screen so that members can easily understand them.
2. The Operator may amend these Terms within the scope that does not violate applicable laws including the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce, and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
3. When the Operator amends these Terms, the effective date and reason for the amendment shall be announced on the Service screen at least 7 days before the effective date. However, for changes that are unfavorable or material to members, announcements shall be made at least 30 days in advance.
4. If a member continues to use the Service after the effective date of the amended Terms, the member shall be deemed to have agreed to the amendment. A member who does not agree to the amended Terms may terminate the usage agreement (withdraw membership).
Article 4 (Provision and Change of Service)
1. The Operator provides the registration, search, and inquiry of in-game item trade listings, offers (bids) on listings, counterparty connection, reviews and ratings, item information browsing, attendance and activity points (Mana), and other services determined by the Operator.
2. The Service is provided in five languages (Korean, English, Simplified Chinese, Japanese, and Traditional Chinese).
3. The Operator may change or suspend all or part of the Service as necessary for operational or technical reasons, and shall give advance notice on the Service screen. However, for urgent or unavoidable reasons, the notice may be given after the fact.
4. The Service is in principle provided 24 hours a day, every day of the year. However, the Service may be temporarily suspended for system maintenance, faults, natural disasters, or similar reasons.
Article 5 (Formation of Usage Agreement and Membership)
1. The usage agreement is formed when a person who wishes to use the Service agrees to these Terms and completes the Battle.net account authentication process and the in-service registration steps (entering nickname, language, etc.).
2. The Service does not maintain a separate ID or password for membership; only Battle.net account authentication (OAuth) is used as the authentication means.
3. The Service is intended for users who can normally play Diablo IV, and children under the age of 14 are restricted from using the Service or registering as members.
4. The Operator may refuse to enter into the usage agreement or terminate the agreement after the fact for applications that misuse another's identity or account, contain false information, are made for fraudulent purposes, are made by children under 14, or otherwise violate these Terms or applicable laws.
Article 6 (Member Information and Nickname)
1. A member uses the Service by setting a nickname. Nicknames must be 3–12 characters in length, allow only Latin letters (upper/lowercase), digits, and Korean characters, must not start with a digit, and must not contain whitespace, special characters, or any forbidden words designated by the Operator.
2. If there is a change in member information (such as language used), the member shall update it on the in-service settings screen. The editable scope for the nickname and Battle.net account information follows in-service guidance.
3. Members shall not allow third parties to use their Battle.net account or service usage rights, and shall bear responsibility for any damages caused by negligence in this regard.
Article 7 (Members' Obligations)
Members shall not engage in any of the following acts:
1. Entering false information when creating listings, making offers, or writing reviews.
2. Creating listings or making offers without any intention or ability to trade.
3. Manipulating market prices or creating false trade information through repeated trades, repeated listing/deletion with the same account, or similar activities.
4. Misusing or fraudulently using another's identity, account, or information.
5. Infringing the intellectual property rights, honor, or other rights of the Operator or any third party.
6. Posting content contrary to public order and good morals, such as abusive language, defamation, or obscenity.
7. Intentionally obstructing the operation of the Service, or using the Service abnormally through automation programs, macros, or similar tools.
8. Attempting trades through the Service that violate the terms of service or game policies of the game operator (Blizzard Entertainment).
9. Any other act in violation of applicable laws, these Terms, or the usage policies announced by the Operator.
Article 8 (Operator's Obligations)
1. The Operator shall comply with applicable laws and these Terms and shall make efforts to provide a stable Service.
2. The Operator shall make efforts to protect members' personal information in accordance with the Privacy Policy.
3. When opinions or complaints raised by members in connection with the use of the Service are recognized as legitimate, the Operator shall make efforts to address them and may communicate the handling progress and results to the member.
Article 9 (Nature of the Brokerage Service and Limitation of Liability)
1. The Service is a platform that brokers the registration, search, and counterparty connection of information about in-game item trades between members. The Operator is not a party to any trade between members.
2. The actual transfer of in-game items, the payment of consideration (such as game currency), the agreement on trade conditions, and the performance of the trade are carried out entirely between the trading parties (members) within the game; the Operator is not involved.
3. The Operator does not guarantee the truthfulness, accuracy, or legality of the listing information registered by members, the success of any trade, the trustworthiness of counterparties, or the outcome of any trade.
4. Disputes arising in connection with trades between members shall in principle be resolved between the trading parties, and the Operator has no obligation to intervene in such disputes. However, the Operator may cooperate by providing information within the scope necessary for smooth Service operation.
5. The Operator does not guarantee whether trades made through the Service violate the game operator's terms of service or game policies, and shall not be liable for any disadvantages (such as game account sanctions) incurred by members as a result.
Article 10 (Listing, Offering, and Trading)
1. Members may create listings according to the methods determined by the Service. Mana is deducted upon listing.
2. Listings automatically expire if no trade is concluded within a certain period after creation. Expired listings may be re-registered.
3. Members may make offers (bids) on other members' listings. Mana is deducted when making an offer.
4. The lister may accept or reject received offers; upon acceptance, the trade procedure proceeds.
5. Detailed rules concerning trade completion, Mana refunds, quantity deduction/restoration, and other trade-related matters follow in-service guidance and operational policies.
Article 11 (Mana and Member Tier)
1. Mana is an in-service activity point granted to members free of charge by the Operator; it cannot be refunded as cash and has no monetary value.
2. Mana is used for in-service activities such as creating listings and making offers, and is restored or accrued through activities designated by the Operator, including attendance and writing reviews.
3. The Operator may change the criteria for granting or deducting Mana and the member tier policy as needed for Service operation, with important changes announced in advance.
4. When a member terminates the usage agreement or the Operator terminates the agreement, any remaining Mana shall be forfeited and shall not be separately compensated.
Article 12 (Content Management and Intellectual Property)
1. The member who posts content on the Service is responsible for that content.
2. If the Operator determines that content posted by a member violates these Terms or applicable laws, the Operator may delete, hide, or restrict the posting without prior notice.
3. Members consent to the use, reproduction, and display within the Service of content they post, for purposes such as Service operation, screen composition, and search result display.
4. Intellectual property rights to the Service and its included design, UI, and software belong to the Operator. However, rights to Diablo IV game data, item names, and game images belong to the game operator and other rightful owners, and the Service uses them solely for the purpose of providing trade information.
Article 13 (Member Block Function)
1. Members may block specific other members through the function provided by the Service.
2. When a member is blocked, the blocked member's listings may be excluded from search results or otherwise restricted from in-service exposure.
3. Members may directly unblock blocked users.
Article 14 (Restriction of Use and Termination of Agreement)
1. The Operator may take measures such as warnings, content deletion, temporary suspension, or permanent termination of the usage agreement when a member violates these Terms or applicable laws.
2. Members may request termination of the usage agreement (membership withdrawal) at any time through in-service procedures or by emailing supportonlytems@gmail.com.
3. When the usage agreement is terminated, the member's personal information shall be handled in accordance with the Privacy Policy.
4. When the Operator terminates the usage agreement on grounds of a member's breach of the Terms, the Operator shall endeavor to notify the member in advance and provide an opportunity to be heard. However, in urgent cases, notice may be given after the fact.
Article 15 (Disclaimer)
1. The Operator shall not be liable for failure to provide the Service due to reasons beyond the Operator's reasonable control, such as natural disasters, DDoS attacks, communication outages, or changes in policy or service interruptions by the game operator or external service providers.
2. The Operator shall not be liable for Service usage failures caused by a member's own fault.
3. The Operator shall not be liable for the outcome of trades between members or the reliability or accuracy of information obtained by members through the Service.
4. The Service is provided free of charge. Unless otherwise specifically provided by applicable laws, the Operator shall not be liable for any damages to members arising from free-of-charge use of the Service. However, this does not apply to damages caused by the Operator's intentional or gross negligence.
Article 16 (Dispute Resolution and Governing Law)
1. The laws of the Republic of Korea shall govern any dispute between the Operator and a member arising in connection with these Terms or the use of the Service.
2. Litigation concerning disputes between the Operator and members in connection with the use of the Service shall be filed with the court having jurisdiction under the Civil Procedure Act.
Supplementary Provisions
These Terms shall take effect on May 21, 2026.
